Mayor Jaime Capil Challenges Ombudsman Ruling in Court of Appeals

Jaime Capil, the Mayor of Porac, Pampanga, has officially filed a motion for reconsideration with the Court of Appeals (CA), seeking to overturn a previous ruling that affirmed his dismissal from public service. The legal battle stems from allegations of gross neglect of duty regarding the regulation of a Philippine Offshore Gaming Operator (POGO) that operated within his jurisdiction.

The controversy centers on the operations of Lucky South 99, a POGO hub that was the subject of high-profile raids last year. Authorities uncovered evidence of human trafficking, physical abuse, and various cybercrimes within the facility. The Office of the Ombudsman subsequently ordered Capil’s dismissal, citing his failure to monitor and intervene in the illegal activities occurring under his administration.

Grounds for Dismissal and Legal Defense

The Ombudsman’s investigation concluded that there was substantial evidence to prove Capil committed gross neglect of duty. Specifically, the office pointed to the issuance of business permits to Lucky South 99 between 2021 and 2023, despite the company lacking mandatory requirements, such as a Letter of No Objection (LONO) from the local council and proper registration with the Securities and Exchange Commission.

In his defense, Capil has maintained that he acted within the scope of his authority and that the primary responsibility for regulating POGO licenses lies with national agencies. He has expressed his intent to exhaust all legal remedies to clear his name, describing the dismissal as a challenge he is ready to face through the proper judicial channels.

Impact on Local Governance and Reelection Bid

The dismissal order carries severe administrative penalties, including the perpetual disqualification from holding any public office, the cancellation of government service eligibility, and the forfeiture of retirement benefits. Despite these sanctions, Capil has signaled his intention to proceed with his reelection bid in the upcoming May polls while the legal process continues.

While the Ombudsman has held Capil liable, administrative charges against several other local officials—including the Vice Mayor and members of the municipal council—were dismissed due to a lack of evidence. The case remains a focal point in the broader national crackdown on illegal offshore gaming operations and the accountability of local executives in monitoring such hubs.
